Philadelphia BEPP Penalties: Fines for Noncompliance and Late Compliance

Missing a BEPP compliance deadline can result in a $2,000 initial fine plus $500 per day in ongoing penalties. Here's what Philadelphia building owners should understand about the BEPP violation and fine structure.

Check your building's BEPP status

Philadelphia BEPP fines and penalty structure

Based on City program information, buildings that fail to comply with BEPP requirements by the applicable deadline may face the following penalties:

$2,000 initial fine

An initial fine of $2,000 may be assessed for noncompliance following the applicable BEPP deadline.

$500 per day after 30 days

After the first 30 days following the applicable deadline, an additional $500 per day may accrue until the building comes into compliance. This means a building that remains out of compliance for 90 days past the deadline could face fines of $2,000 + (60 × $500) = $32,000 or more.

Exact enforcement and penalty application depend on the City's rules and individual circumstances. This is not legal advice.

How penalties accumulate

The daily penalty structure means that delay compounds the financial exposure significantly. The table below illustrates how penalties may accumulate based on City program information:

Days past deadlinePotential cumulative fine
1–30 days$2,000
60 days$17,000
90 days$32,000
180 days$77,000
365 days$169,500

Why address noncompliance promptly

Beyond the direct financial penalties, noncompliance with BEPP may have other consequences for building owners and property managers:

Penalties accrue daily — the longer compliance is delayed, the greater the total exposure.

Noncompliance may affect property transactions, financing, and due diligence processes.

City enforcement actions may include liens or other remedies beyond fines, depending on City rules.

Options if you've missed a deadline

If a BEPP deadline has passed or is approaching and your building has not yet complied, the most important step is to understand your current status and available options. Depending on the circumstances, options may include:
